Removal proceedings (formerly called deportation proceedings) are administrative court proceedings in which foreign nationals are charged by the U.S. Department of Homeland Security (DHS) with being removable from or inadmissible to the United States. An individual in removal proceedings (the “respondent”) has the right to an attorney, but does not have the right to a court appointed attorney because removal proceedings are not criminal proceedings.  Immigration law is extremely complex, and having competent legal counsel in removal proceedings is critical in increasing a respondent’s chances of remaining lawfully in the United States.

Non-permanent residents may be placed in removal proceedings for violations like entry into the United States without inspection (also known as “EWI”), overstaying a period of authorized stay, being in the U.S. without being admitted or paroled, and others.  

Permanent Residents (sometimes known as “green card” holders or LPR’s) may be placed in removal proceedings for violations like abandonment of permanent residence, conviction of certain crimes (see Immigration Consequences of Criminal Activity), termination of conditional resident status, and more.

A respondent may contest removability or inadmissibility before the Immigration Judge. The Law Offices of Dominic E.
